FOURTH WAVE WINE ‘LITTLE GIANT’ PROMOTION

Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

The promoter is Fourth Wave Wine Partners Pty Ltd (ABN 32 243 483 797) of Suite 1, Level 3 240-244 Pacific Highway, Charlestown NSW 2290. (“Promoter”).

Entry is only open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter, Participating Stores (as defined below) and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

Entries into the promotion open on 01 July 2022 and close at 11:59pm AEST on 30 September 2022. (“Promotional Period”).

To enter, individuals must complete the following steps during the Promotional Period:

Purchase any specially marked bottle of Little Giant wine (750ml) (with the promotional neck tag QR code) (“Eligible Product”) from a Participating Store during the Promotional Period (“Qualifying Transaction”). In the event a purchase receipt is not automatically provided by a staff member, it is the individual’s responsibility to request one.

Scan the QR code located on the Eligible Product’s neck tag using a mobile device to launch the promotional website, input the requested details (including full name, age, email address and contact number) with the option to follow the Promoter’s social media and subscribe to mailing list and submit the fully completed entry form.

A participating store is any retail store in New South Wales, Victoria, Queensland, South Australia, Western Australian, Tasmania and Australian Capital Territory that stocks the Eligible Product (“Participating Store”).

Multiple entries permitted, subject to the following: (a) only one (1) entry is permitted per Eligible Product purchased; and (b) each entry must be submitted separately and in accordance with these Terms and Conditions.

Entrants must retain a copy of their original purchase receipt(s) for all entries as proof of purchase. Failure to produce proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of all of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the Participating Store of purchase, that the purchase was made during the Promotional Period but prior to entry.

The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

The Promoter’s decision is final, and no correspondence will be entered into.

Incomplete or illegible entries will be deemed invalid.

The Winners will be drawn at AEST 10:00am on 4 October 2022 at Suite 1, Level 3, 240-244 Pacific Highway, Charlestown NSW 2290.

The Winners will be notified in writing and via telephone and email per the contact details provided upon entry to the promotion within two (2) business days from the date the winner is drawn. Winners will be posted on www.fourthwavewine.com.au within two (2) business days from the date the winner is drawn. There are five (5) possible Prizes which may be won, the prizes are listed below:

Giant Wine Tour: A tour of Europe’s wine regions of Italy, France and Spain which includes nine (9) nights’ accommodation for two adults, flights and transfers to the winner’s nearest international airport, some meals and tours with total value of $15,000.00 per prize (“Major Prize”). The quantity of Major Prizes available to be won is one (1) across participating states (NSW, VIC, QLD, SA, WA, TAS & ACT).

Australian Wine Tour: A tour of South Australia’s Barossa Valley wine region or New South Wales’ Hunter Valley wine region includes two (2) nights accommodation for two (2) adults with a total value up to $2,000.00 per prize (“Secondary Prize”). The quantity of Secondary Prizes available to be won is four (4) across participating states (NSW, VIC, QLD, SA, WA, TAS & ACT) with 2 (two) available per location. The location chosen for a Winner of a Secondary Prize will be at the discretion of the promoter.

Subject to the unclaimed prize draw, if for any reason a winner does not take/redeem a prize (or an element of the prize) before AEST 10:00am on 21 October 2022, then the prize (or an element of the prize) will be forfeited.

If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

The total prize pool value is up to $23,000.

A draw for any prizes that have been won but unclaimed will take place at AEST 10:00am on 24 October 2022 at Suite 1, Level 3, 240-244 Pacific Highway, Charlestown NSW 2290, subject to any directions from a regulatory authority. Only entries that have not won a prize already will be entered into the relevant unclaimed prize draw. Winners (if any) will be notified in writing within two (2) business days of the draw. Winners’ names will be published online at www.fourthwavewine.com.au within two (2) business days from the date the winner is drawn. Prizes will be considered to be won but unclaimed if the Winner fails to contact the Promoter to collect the prize before AEST 10:00am 10 November 2022.

Prizes are subject to availability and must be taken in accordance with all requirements specified by the Promoter, such as dates and destinations. The Major Prize will also be subject to the travel restrictions current at the time the Major Prize is taken by the Winner. If Fourth Wave Wine Partners encounters any issue in enforcing the above-mentioned itineraries, Winners will be contacted as soon as practicable and will be provided with a revised itinerary to the same value.

The Major Prize includes departure from the Winner’s nearest capital city airport including all necessary transfers. Winners will fly from their nearest capital city to Madrid-Barajas Airport and will undertake the below itinerary before arriving in Paris, where they will depart by plane from Rimini Referico Fellini International Airport and arrive back in the airport of their nearest capital city. Flights provided with the Major Prize will be economy class valued up to $2,300.00 per person. The Major Prize does not include baggage claims, fees resulting from booking changes or cancellations, travel insurance, beverages and any other cost not specified in the Prize details including, booking change fees or cancellation fees or any other costs of a personal nature not stated.

The Major Prize includes activities or meals as provided for in the below itinerary in addition to breakfast provided daily. Winners of the Major Prize will be given AU$2,000.00 spending money.

Transportation from the Major Prize Winner’s place of residence to the nearest capital city will be provided, including any required transportation by car or plane. If the Winner lives in rural or regional Australia and cannot travel by car to their nearest capital airport, flights from the Winner’s closest airport to the nearest capital airport will be provided including all necessary transfers (if any). Dependant on the scheduling of flights for the Major Prize, if necessary Fourth Wave Wine may provide accommodation for the night prior to the Winners departing flights from their nearest capital city, and also for the night prior to the Winners departing flights from Paris Airport.

Accommodation under the Major Prize will be boutique accommodation and will follow the following itinerary:

Winners will travel by car from Madrid-Barajas Airport to Logrono, where they will spend two (2) nights in Logrono Hotel Calle Mayor. On the first night Winners will be provided with a guided tapas crawl. On the second night Winners will be provided with a guided tasting and tour of the Condes de Los Andes Cellars.

Winners will then travel by car to San Sebastian and stay for one (1) night in the Hotel Londres Angleterre. Dinner to the value of $750.00 will be provided.

Winners will then travel by car to s where they will stay for two (2) nights. Dinner for each night to the value of $500.00 is included along with wine tastings at Les Jamelles and Metaririe Wineries.

Winners will then travel by train to Burgundy and stay for two (2) nights at Hotel de la Poste. A guided tour and tasting of two wineries – Eduard Delanunay and one other (to be decided) will be included.

Winners will then fly from Paris to Florence, where they will stay for two (2) nights at NH Collection Firenze.

Winners will then travel by car to Rimini Federico Fellini International Airport, where they will depart for their closest capital city.

The Secondary Prize includes transportation to the Winner’s closest airport and flights to either Adelaide, South Australia or Williamstown, New South Wales. Flights provided in the Secondary Prize will be economy class. The Secondary Prize does not include baggage claims, fees resulting from booking changes or cancellations, travel insurance, beverages and any other cost not specified in the Prize details including, booking change fees or cancellation fees or any other costs of a personal nature not stated. Winners will be provided with AU$300.00 spending money total and car hire for the duration of the prize.

Accommodation under the Secondary Prize will be two (2) nights’ accommodation at either Novotel or Crown Plaza at Barossa Valley or the Hunter Valley (subject to availability and location of the Secondary Prize). Winners of the Secondary Prize (Barossa Valley region) will be provided with wine tours and dinner in two (2) wineries within the Barossa Valley and Adelaide Hills. Winners of the Secondary Prize (Hunter Valley region) will be provided with wine tours and dinner in two (2) wineries within the Hunter Valley. Wineries selected under the Secondary Prize are subject to availability and are at the discretion of the Promoter.

Prizes available under this promotion must be taken between 11 November 2022 and 01 May 2023.

Unless stated otherwise, the Winners will be responsible for all ancillary expenses in relation to the prize which aren’t expressly included in the prize description. The Winners must not commit the Promoter to any cost or expense without prior written consent (which the Promoter is not obliged to give) and will remain liable for such costs if they attend to do so.

Prizes are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

The Promoter encourages consumers to enjoy responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au. Entry and continued participation in this promotion is subject to the licensee’s liquor serving policy.

Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the internet service provider used.

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention, fraud or pandemic, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

Printing and other quality control errors will not invalidate an otherwise valid prize claim. Instant win game materials void if stolen, forged, mutilated or tampered with in any way.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use, and handle PI as set out in its Privacy Policy, which can be viewed at www.fourthwavewine.com.au In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia.
